We must know we are next in line for him, because Shanahan told the media we are making another claim on him. Not something you'd want to advertise unless there was no one in front of you that could get him.

With 13 days to evaluate whether or not he will be healthy enough to contribute, it would make sense to bring him in. I don't know what impact his physical status has on a contract offer.
He has talent. I think at this point where we are you take the risk and claim him. Maybe regains form and can help replace Ford for a lot cheaper price next year
What caused the failed physical? He would be a nice piece on the D line going forward. I hope the Niners put in a claim again.
Reports are that he has had a groin issue since early in the season.

Can you successfully claim a player that fails a physical? If you can, why didn't Bengals just put him on IR? Its not like they are making the playoffs this year.

It's on the team. Just like any trade. Usually a team won't take a player that fails the physical but they can if they want to. The Bengals probably wanted him to play now so they can evaluate him. Being that he can't play he's not worth even putting him on IR in their opinion. I'm not sure about the cap implications. Maybe the Falcons would be on the hook for the rest of his salary this year?
