I tend to agree with you. The real danger (as far as Niner fans are concerned) is that Goodell will construct the bulk of the penalty in the form of a large fine, which wouldn't help the Niners at all, and which wouldn't affect the "balance of competition" around the league. Most of the other owners would probably strongly pre3fer this monetary punishment for the offending team, because it doesn't affect the other 3 teams. Goodell could appear to be firm by making the fine a big number.
Now the Niners would need to get SOMETHING, as the offended team, but a 1st-rounder has too much impact on all the other (innocent) teams. A 2nd or 3rd rounder, plus the fine seems most likely. Another factor, if this affair drags out to next spring, is that the draft pick part of the penalty could well be in the 2011 draft, instead of the 2010 draft.
The Niners are more likely to get a higher draft pick by trading Crabtree after March 5, than they would be awarded by Goodell in the tampering matter. I think that the club is likely to get additional picks on both fronts.
