Why is Toby not a senior? He played in 4 seasons.
The thing was he COULD have applied for a medical red-shirt or whatever for his 2007 season when he sustained a knee injury.
But he never applied for that, and thus, he is a senior. He just had the option of aplying to the NCAA for another year of eligibility (it wouldn't be a guarantee they granted it). So its not about whether he announces, its whether he decided to apply for another year of eligibility. So he is draft eligible unless he declared otherwise.

I still think it's a joke that S. Spencer wasn't envited. He wound up being a second round pick and has started in the league for years.
