Irrelevant. This is like saying the driver of a car wouldn't have been hit by a drunk driver if he was 2 lanes over from the drunk driver instead of next to him.
It's not irrelevant it's the entire point. Marsh basically puts himself on a path to slam into an official. Not cool. The offending party here is Marsh. The game official is literally standing flat footed not moving until Marsh gets up in his business.
Your hypothetical is silly because it assumes the ref is a drunk driver (at fault). The ref is standing there minding his own business (not at fault).
