Let's clarify.

Everyone says that Kaepernick is "entitled" to his expression. I agree, but that is a choice, it is not a right. The first amendment does not protect him from disciplinary action by the team or the league, up to and including dismissal.

The first amendment prohibits Congress from making any law abridging freedom of speech. That means it can't be a crime, and he can't be prosecuted or incarcerated for it. That's what he's "entitled" to. That's all. If a private firm thinks he's harming it's public image and determines it's in it's best interest to take action, the first amendment is no defense.


"Congress shall make no law respecting an establishment of religion, or prohibiting the free exercise thereof; or abridging the freedom of speech, or of the press; or the right of the people peaceably to assemble, and to petition the Government for a redress of grievances."

Still, I'd cut him on performance.

How was that personal? We live in an era of shallow hashtag activism where people think retweeting something makes them committed to a cause. Its not any different than those who roll around with "Support the Troops" bumper stickers on the back of their Chevy Tahoe. What percentage of those actually go out and volunteer at the VA hospital or other veterans organizations? How many are really "supporting the troops?"


When I hear about Kaepernick working with community leaders and police, working to address these issues that he's supposedly really mad about rather than just retweeting a whole bunch of stuff, I'll applaud him for doing work. Because of his celebrity status he gets access to people that the average person otherwise may not. People will answer the phone for him that they may not for your neighbor or some random person. The ability for him to make change happen on a local scale is out there. If he goes and puts the time in, we all should applaud him.


Otherwise can you blame those who see this as a self-serving ploy to get set free from a team that he no longer wants to be on?

I am honestly just tired of Kaep.

If the man is doing what he believes is right, then that is fine, I am not going to argue with another man over his beliefs whether I agree or not.

I have a problem with his football career on the Niners. He has become a distraction and a lousy player over the last couple of years. I know not all of it is his fault but he hasn't helped either.

I really want to get rid of him somehow so Driskel can be the number 2 and actually take meaningful reps to develop. I am a big fan of Driskel.

Lol. Nothing he said was personal. He's just calling a spade a spade. Maybe you and Blindfury should stop being so emotionally invested in a backup QB that'll probably never play again. Be a 49ers fan. Thanks.
