Is this truly the time in the pocket? Does this not account for the times when Hurts or any qb scrambles outside of the "pocket" and then makes a throw?.

Yes. That is his average time in the pocket. His average time to throw when he scrambles is 4.05 seconds which is the highest in the NFL.
